Wildtracks Terms of Use

These Terms of Use ("Terms") govern your use of the Wildtracks mobile application and website (the "service"), provided by Birdbrain AS, a company registered in Norway (organisasjonsnummer 938 182 574) ("we", "us"). By creating an account or using the service you agree to these Terms. If you do not agree, do not use the service. Questions can be sent to support@wildtracks.app.

1. The service

Wildtracks helps you train dogs to follow blood trails. You lay a trail with GPS, walk it later with your dog, and compare the dog's route with the trail. You can keep profiles for your dogs, view statistics, and share trails and walks with friends.

Wildtracks is a training tool. It is not a navigation or safety device, and it is not a substitute for your own judgement or for an approved tracking team in a real search for wounded game. GPS positions can be inaccurate, and recording can stop if your device loses signal, runs out of battery or restricts background activity. You are responsible for following hunting, animal welfare and access rules, including landowner permission where it is required, and for your own and your dog's safety in the field.

2. Your account

You need an account to use the app. You must give accurate information, keep your sign-in details to yourself, and tell us if you believe someone else has access to your account. You must be at least 13 years old, or the minimum age required in your country. You are responsible for what happens under your account.

3. Free plan and Pro

The free plan lets you use Wildtracks with some limits, such as the number of trails and dogs you can create and how far back statistics go. Wildtracks Pro removes those limits and adds features that the free plan does not include. The current limits and Pro features are shown in the app.

If Pro ends, nothing you have made is deleted. You keep your trails, walks, dogs and statistics, and you can view and use them as before. You cannot create more than the free plan allows until you are back under its limits or subscribe again.

We may give Pro without charge, for example to people who used the app during its beta, to app reviewers or as part of support. Such access lasts for as long as we said when it was given.

4. Subscriptions and payment

  • Purchase. Pro is sold as an auto-renewing subscription, monthly or yearly, through the Apple App Store or Google Play. Payment is charged to your App Store or Google Play account when you confirm the purchase. The store handles the payment, and its own terms apply to it.
  • Renewal. Your subscription renews automatically at the end of each period at the price then in effect, unless you cancel at least 24 hours before the current period ends. Your account is charged for the renewal within the 24 hours before the period ends.
  • Free trials. If a free trial is offered, it turns into a paid subscription when it ends unless you cancel at least 24 hours before. Any unused part of a trial ends when you buy a subscription.
  • Cancelling. You can cancel at any time in your App Store or Google Play subscription settings. Uninstalling the app or deleting your account does not cancel the subscription with the store. After cancelling, you keep Pro until the end of the period you have paid for.
  • Refunds. Because the store takes the payment, refund requests are handled by Apple or Google under their refund policies. We cannot issue refunds for store purchases ourselves.
  • Price changes. If we change the price, you will be told in advance as the store requires, and where the store asks for your consent to a higher price, the subscription will not renew at that price without it.

5. Your content

You own the content you add, such as trails, walks, photos, and dog profiles. You give us permission to store, process, and display that content so we can run the service for you, including showing it to the people you choose to share it with. This permission ends when the content is deleted, except for copies we must keep by law. How we handle personal data is described in the privacy policy.

When you share a trail or walk with a friend, they can see it and may copy it into their own account. Only share what you are comfortable with them having.

6. Acceptable use

You agree not to:

  • upload content that is illegal, or that you do not have the right to share;
  • harass other users or misuse the friend and sharing features;
  • try to get around plan limits, access other accounts or data you are not permitted to see, or disrupt or overload the service;
  • copy, resell, or reverse engineer the service, except where the law allows it.

7. Deleting your account

You can delete your account in the app at any time. Deletion takes effect after a 30-day grace period, during which you can change your mind by signing in again. The details are on the delete account page. We may suspend or close an account that seriously or repeatedly breaks these Terms. Where reasonable, we will tell you first and give you a chance to fix it.

8. Changes to the service and these Terms

We work on Wildtracks continuously, so features may be added, changed, or removed. We may also update these Terms. If a change significantly affects you, we will tell you in the app or by email before it takes effect. If you do not accept the change, you can stop using the service and cancel your subscription.

9. Liability

We aim to keep Wildtracks available and accurate, but we cannot promise that it will always work without interruption or errors, or that GPS data will be exact. To the extent the law allows, we are not liable for indirect losses, or for losses caused by relying on the service in the field. Nothing in these Terms limits liability that cannot be limited by law, or your statutory rights as a consumer.

10. App Store terms

If you downloaded Wildtracks from the Apple App Store, Apple's standard Licensed Application End User License Agreement also applies. These Terms are between you and Birdbrain AS, not Apple, and Birdbrain AS is responsible for the app and its support.

11. Governing law and complaints

These Terms are governed by Norwegian law. If you have a complaint, contact us first at support@wildtracks.app and we will try to resolve it. As a consumer you can also bring a complaint to Forbrukertilsynet or Forbrukerrådet, and a dispute can be brought before the courts where you live.
